Terms of Service

Last updated: February 19, 2026 · Applicable to all services provided by ForoFlow.

By hiring or using the services of ForoFlow (operated by Eddy Fonseca Rojas), you accept these Terms of Service. We recommend reading them in full before starting any project.

1. Provider identification

Location: Costa Rica — Global remote services

2. Services Offered

ForoFlow provides the following consulting and technological development services:

  • Design and implementation of omni-channel AI chatbots (WhatsApp, Web, Instagram, Facebook)
  • Automation of Lead-to-Call flows with AI pre-qualification
  • Process automation and system integration via APIs
  • Automation of document management (invoices, contracts, orders)
  • ERP / CRM synchronization and data unification
  • Real-time analytics & KPI dashboards
  • RFID traceability systems for asset control
  • Diagnosis and general digital transformation consulting

The exact scope of each project will be defined in a specific service proposal or agreement.

3. Contracting Process

The service relationship is established as follows:

  1. Request: The client completes the diagnosis form on this site.
  2. Diagnosis: A 30-minute session is held to analyze the case.
  3. Proposal: ForoFlow presents a roadmap and economic proposal.
  4. Agreement: Both parties sign (physically or digitally) a service agreement.
  5. Start: The project begins with the payment of the agreed advance.

The contact form on this site does not constitute a contract; it is only the first step of communication.

4. Fees and Payments

Fees are agreed specifically for each project according to its scope, complexity, and estimated time. The general conditions are:

  • Prices are quoted in USD (American dollars) unless otherwise agreed
  • A 50% advance is required to start the project
  • The remaining balance is paid in milestones defined in the proposal
  • Payments are made by bank transfer or agreed platforms
  • Invoices are issued according to current Costa Rican regulations

⚠️ Advances are non-refundable if the client cancels the project after work has started.

5. Intellectual Property

Upon conclusion of full payment for the project:

  • The client receives full use rights over the automations, flows, and code developed specifically for their project
  • ForoFlow retains the right to use the project as a portfolio reference (without revealing client confidential data)
  • The third-party tools, frameworks, and libraries used are governed by their own licenses
  • ForoFlow does not transfer rights over own methodologies or reusable templates

6. Confidentiality

ForoFlow commits to maintaining strict confidentiality over:

  • Internal process information, contractor's client data, and business metrics
  • Access to systems, APIs, and credentials provided for development
  • Any information marked as confidential by the client

This obligation remains effective for 2 years after the service relationship has concluded.

7. Client Obligations

For the correct development of the project, the client commits to:

  • Provide access, information, and resources needed within agreed timeframes
  • Designate a contact point with decision-making capacity
  • Review and approve deliverables within a maximum of 5 business days
  • Not use the software developed for illegal or unethical purposes
  • Comply with payments within agreed timeframes

8. Warranties and Support

ForoFlow offers the following warranties on delivered projects:

  • Warranty period: 30 calendar days from final delivery
  • During warranty, errors attributable to development are corrected at no cost
  • Errors caused by client or third-party changes are not covered
  • Post-warranty ongoing support is quoted as an additional service

9. Limitation of Liability

ForoFlow will not be responsible for:

  • Business losses derived from interruptions in third-party services (APIs, cloud platforms, etc.)
  • Damage caused by incorrect use of delivered tools
  • Changes in external platform policies that affect automations (e.g., WhatsApp Business API, Meta)
  • Data loss if the client does not maintain their own backups

The maximum liability of ForoFlow in any case will be limited to the total value of the project in question.

10. Cancellation and Termination

By the client: The project can be cancelled with 5 business days written notice. Work performed up to the cancellation date will be billed.

By ForoFlow: We reserve the right to terminate the service relationship if the client breaches these terms, with a proportional refund of the unworked part of the payment received.

11. Data Protection and GDPR

The processing of personal data by ForoFlow is governed by our Privacy Policy. If the client is located in the European Union or the European Economic Area, both parties commit to complying with the obligations of Regulation (EU) 2016/672 (GDPR), with ForoFlow acting as data processor or independent controller according to the scope of the project.

12. Applicable Law and Conflict Resolution

These terms are governed by the laws of the Republic of Costa Rica. In case of dispute, the parties will attempt to resolve it in good faith. If an agreement is not reached, the resolution will be submitted to the Courts of Justice of Costa Rica.

For international clients, the parties may agree on an alternative arbitration mechanism.

13. Modifications

ForoFlow may update these Terms of Service. Changes will be published on this site with the update date. Contracts already in effect are not affected by subsequent changes unless expressly agreed by both parties.
